WCB advocacy & fairness reviews

If you’ve ever felt that your WCB claim wasn’t handled fairly – not just the decision itself, but how you were treated or how the process was managed, there is a place within WCB called the Fairness Review Office. This office is meant to provide an independent review when workers or employers believe they weren’t treated respectfully, weren’t given clear information, or when the process itself didn’t feel fair.

The Fairness Review Office doesn’t change WCB’s claim decisions. Instead, it looks at how the decision was made and whether the proper process and respectful communication were followed. For example, you might consider a fairness review if:

  • You felt disrespected or dismissed by WCB staff,
  • You weren’t given enough explanation for a decision,
  • The process took too long or didn’t give you a chance to be heard.

Your WCB advocates have made numerous submissions to the Fair Practices Office on members’ behalf. This has resulted in several members receiving apologies from WCB supervisors and managers about how their claim was handled. This also provides the member the opportunity to express how mishandling their claim / injury has impacted them personally.

Your fellow member, J. Ibra (JBS) had this to say when UFCW asked for an apology directly from a WCB supervisor, about the improper handling of her claim:

“I was so happy for the union to stand up for me through all difficulty through WCB. I didn’t expect a call, and it was because of 401. After the call I had a healing in my heart.”
