This is a post about wage replacement rates, in particular for Union members at Cargill who have workplace injuries dating back to 2022 or before.
As Alberta’s Workers’ Compensation Board defines it:
Wage replacement refers to replacing lost employment income resulting from your workplace injury or illness. To pay you wage loss replacement benefits we set a compensation rate based on the amount of money you were earning at the time of your workplace injury/illness.
Your compensation rate can make a huge difference to the overall value of your benefits.
When Cargill last renewed their Collective Bargaining Agreement (which was ratified in December 4th, 2021), retroactive wage increases were applied going back to January 3rd, 2021: a $2.00 per hour increase.
When determining your rate of compensation, the WCB bases the relevant earnings on the year prior to the date of accident. In the case of Cargill, this means that anyone with an injury in 2022 could qualify to have their rate adjusted accordingly.
WCB Advocate Keri Grainger says:
“Last year I embarked on a bit of a mission to ensure that any file in which UFCW was authorized, with a date of injury in 2022, was reviewed for an adjustment. Although it took some time to get the ball rolling, we have had a few good outcomes. It’s only a small number of members, but we have to remember those who did not authorize UFCW who may also be entitled to this rate review.”
Members who have authorized our WCB department to review their files have seen added benefits to the tune of hundreds or even thousands of dollars. While this is a small number of cases so far, they make it clear that reviewing your rate is worth doing.
